These Terms of Service (“Terms”) govern your use of the Sidekick mobile application (the “App”) and any Sidekick websites that link to these Terms (the “Site”). By accessing or using the App or Site, you agree to these Terms. If you do not agree, do not use Sidekick.

1. What Sidekick is

Sidekick helps parents discover kids’ activities and provides links to third-party websites to view more information and/or make bookings. Sidekick does not operate the activities and does not generally take payment for bookings made on third-party websites.

2. Eligibility

You must be at least 18 years old to create an account or use Sidekick. If you use Sidekick on behalf of another person or organisation, you confirm you have authority to do so.

3. Accounts and security

If you create an account, you are responsible for:

  • keeping your login details confidential; and

  • all activity that happens under your account.

If you believe your account has been compromised, contact us immediately at info@mysidekick.uk.

4. “Book now” click-outs and third-party bookings

When you tap “Book now” (or similar), you will be taken to a third-party website or service operated by the activity provider or a booking/ticketing platform (a “Third-Party Site”).

Important: Any booking, ticket purchase, membership purchase, refund, cancellation, rescheduling, complaint, dispute, and customer service relating to an activity is between you and the provider/Third-Party Site. Sidekick is not a party to those transactions and does not control Third-Party Sites.

Third-Party Sites have their own terms and privacy policies. You should review them before booking.

5. Accuracy of listings

We aim to keep information up to date, but activity details (including price, schedule, age suitability, location, availability, and policies) can change and may be inaccurate or incomplete at times. Always check the final details on the provider’s website or booking page before you book.

6. Affiliate links and commissions

Some links in Sidekick are affiliate links. This means Sidekick may earn a commission if you make a purchase after clicking a link (for example, tickets or bookings on a Third-Party Site). This does not usually affect the price you pay, unless the Third-Party Site offers a specific discount.

7. Acceptable use

You agree not to:

  • misuse Sidekick or interfere with its normal operation;

  • scrape, harvest, or copy content or data from Sidekick using automated means;

  • attempt to reverse engineer or bypass security features;

  • upload or transmit malicious code;

  • use Sidekick to send spam or unsolicited communications; or

  • use Sidekick in any way that is unlawful or infringes another person’s rights.

We may suspend or terminate access if we reasonably believe you have breached these Terms.

8. Intellectual property

Sidekick and its content (including the App, software, design, text, logos, and trademarks) are owned by or licensed to us and are protected by intellectual property laws. You may use Sidekick for personal, non-commercial use only. You must not copy, modify, distribute, sell, or lease any part of Sidekick unless we give written permission.

9. User content

If Sidekick allows you to submit content (for example, reviews, comments, or messages) (“User Content”), you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that User Content for the purpose of operating and improving Sidekick. You confirm you have the rights to share any User Content you submit.

We may remove User Content if we believe it breaches these Terms or applicable law.

10. Disclaimers

Sidekick is provided on an “as is” and “as available” basis. To the maximum extent permitted by law:

  • we do not guarantee that Sidekick will always be available, uninterrupted, or error-free; and

  • we do not guarantee the quality, safety, legality, or suitability of any activity or provider listed on Sidekick.

11. Limitation of liability

Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation; or

  • any other liability which cannot be limited or excluded by law.

Sidekick provides an online platform to help users discover third-party activity providers. Bookings, purchases, and participation in activities take place on third-party websites and are governed by the terms of those third parties. We are not responsible for, and shall not be liable for, any losses arising from bookings, purchases, or activities provided by third parties.

Subject to the above, and to the maximum extent permitted by law, Sidekick shall not be liable for:

  • indirect or consequential losses; or

  • loss of profits, revenue, business, goodwill, or anticipated savings.

Where Sidekick is liable to you, our total aggregate liability for all claims arising out of or in connection with the use of the platform shall not exceed the greater of £500 or the total fees paid by you to Sidekick in the 12 months preceding the claim.

12. Termination

You may stop using Sidekick at any time. We may suspend or terminate your access (including your account) if we believe you have violated these Terms, if required by law, or to protect Sidekick, our users, or third parties.

13. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (for example, via the App or Site). The “Last updated” date will show when the Terms were last changed. Continued use of Sidekick after changes means you accept the updated Terms.

14. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or Sidekick, except where consumer protection laws require otherwise.
